(per Hon'ble Sri Justice U. Durga Prasad Rao) Heard learned Additional Advocate General for appellants/respondents 1 to 9 in W.P., and Sri Nazir Ahmed Khan, learned counsel for respondent No.1.

The submission of learned Additional Advocate General is that as directed by the learned Judge in the impugned order, the appellants would complete the survey and submit the sketch with regard to Ac. 13 of land situated at Gudimalkapur Village, Asif Nagar Mandal, by 31.5.2018, but however, since the construction of 2 BHK intended for weaker sections of the society is stalled in view of the impugned order, the same may be modified to enable the government to proceed with the construction of 2 BHK houses subject to the result of the Writ Petition. Learned Additional Advocate General in all fairness would further submit that neither in the past appellants intruded and made any constructions in Ac. 6 of the land allotted to the Mustafa Hills Cooperative Housing Society nor in future they would do that act though the Government have every right to cancel the G.O allotting Ac. 6.00 of land to the said Society.

In the result, the Writ Appeal is disposed of by modifying the impugned order dated 2.5.2018 in I.A.No. 1 of 2018 in W.P.No. 12531 of 2018 to the effect that the appellants would complete the survey of Ac. 13 situated at Gudimalkapur Village, Asif Nagar Mandal, and submit the report as directed in the impugned order by 31.5.2018 and the appellants are permitted to proceed with the construction of 2 BHK houses for weaker sections as usual from the date of this order. The said construction is, however, subject to the result of the Writ Petition. As a sequel thereto, miscellaneous applications pending if any, shall stand closed.
