THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY SECOND APPEAL No.711 OF 2005 JUDGMENT:

This Second Appeal is filed under Section 100 of C.P.C., by the plaintiff, assailing the judgment and decree dated 04.04.2005 passed in A.S.No.150 of 2001 on the file of the Court of the IV Additional Senior Civil Judge (F.T.C.), Vijayawada, wherein and whereby the judgment and decree dated 16.01.2001 passed in O.S.No.1085 of 1997 on the file of the Court of the I Additional Junior Civil Judge, Vijayawada, was set aside. Learned counsel for the appellant seeks permission of this Court to permit the appellant to withdraw the appeal and a letter was also filed in the Registry to that effect. Permission is granted.

Accordingly, the Second Appeal is dismissed as withdrawn. There shall be no order as to costs.

Consequently, Miscellaneous Petitions, if any, pending in this Second Appeal shall stand closed.
