HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Criminal Petition No.5470 of 2018 ORDER :

Heard the learned counsel for the petitioners/ A.2, 4, 5 and 7 of Cr.No.34 of 2018 of Rayavaram Police Station, East Godavari district, and also the learned Public Prosecutor representing the State and perused the bail application averments, the First Information Report and dismissal order of the earlier petition for anticipatory bail passed by the learned X Addl.District and Sessions Judge, East Godavari, dated 20.04.2018 in Crl.M.P.No.377 of 2018.

Though it is the contention of the learned counsel for the petitioners that it is a false case and counterblast to the report of one of the accused persons herein as defacto-complainant against the defacto-complainant herein and the others in Cr.No.39 of 2016 of Anaparthy Police Station. Copy of the FIR in Cr.No.39 of 2016 even not filed much less to show that it is prior to 14/ 15.03.2016.

In fact, the learned Sessions Judge dismissed the anticipatory bail application of not entitled to the concession of bail from the propensity of the crime by the order impugned herein.

Having regard to the above, there re no grounds to give concession of anticipatory bail to the petitioners.

In the result, the Criminal Petition is dismissed. However, it will not prejudice the petitioners' moving of regular bail application on their surrender to decide on own merits. Consequently, miscellaneous petitions, if any shall stand closed.
