- 2 - THE HON'BLE SRI JUSTICE P.NAVEEN RAO CONTEMPT CASE No.89 OF 2016 ORDER:
This Court in W.P.M.P.No.53139 of 2015 in W.P.No.41166 of 2015 directed to continue the petitioner in service until further orders. Alleging violation of the said direction issued, this contempt case is filed.

Learned Standing counsel submits that subsequently, the writ petition was disposed of, along with batch of writ petitions remitting the matter to the Government and the respondentcompanies to take decision on enhancement of the age of superannuation. Thereafter the Government has taken decision to enhance the age of superannuation of the employees working in Transmission Corporation, and also directed to treat the extension of age retrospectively. In consequence to the said decision, a memo was issued on 15.09.2017 directing the petitioner to report to duty and to remit the amount already received by him as retirement benefits in order to issue order of re-admission to duty 3.
Learned Standing counsel submits that petitioner did not remit the amount and did not join duty. He further submits that the Board reviewed the case of the petitioner regarding remittance of the amounts and resolved to relax the condition. He would therefore submit that in terms thereof petitioner can join duty without remittance of the amounts.

Thus, recording the statement of learned Standing counsel and leaving it open to the petitioner to join duty, the Contempt case is closed. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this contempt case shall stand closed.
