HONOURABLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.26618 OF 2015 ORDER:

This Writ Petition is filed by the petitioner seeking to issue a writ of mandamus to declare the inaction of the respondents 1 to 3 in taking action on the complaints made by the petitioner on 05.08.2015 and 09.08.2015 against the illegal and unauthorized construction and demolition by the respondents 4 to 7 in the premises bearing M.No.237, Plot No.6, Jyothinagar, Sy.No.203/2 and 204/3, opposite Srinivas theatre, Ramachandrapuram, Medak District, as illegal and arbitrary and consequently direct the respondents 1 to 3 to take steps against the respondents 4 to 7 for illegal demolishing the structures and digging soil in the above said premises.

The case of the petitioner is that the unofficial respondents i.e. respondents 4 to 7, who are neighbours to the petitioners are making constructions without leaving set backs. The petitioner made representations on 05.08.2015 and also on 09.08.2015 to the 2nd respondent about the illegal construction of the unofficial respondents but, no action has been taken. Aggrieved by the same, this writ petition is filed.

Heard learned counsel for the petitioner and the learned counsel for the respondents.

Sri Sampath Prabhakar Reddy, learned Standing Counsel for the respondents 2 and 3, submitted that necessary action would be taken on the representations of the petitioner. In view of the submission of the learned Standing Counsel for respondents 2 and 3, the 3rd respondent is directed to consider the representations of the petitioner, dated 05.08.2015 and 09.08.2015, after issuing notice to the respondents 4 to 7 and also to the petitioner,

and pass appropriate orders in accordance with law, within a period of three (3) weeks from the date of receipt of a copy of this order. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
