THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2331 of 2016 ORDER:

This criminal petition, under Section 482 of the Code of Criminal Procedure, is filed by the petitioner-Accused No.1 seeking to quash the proceedings in FIR No.8 of 2016 on the file of IV Town Police Station, Visakhapatnam, registered for the offences punishable under Sections 384, 420, 406 and 509 r/w.34 IPC. Heard and perused the material available on record. The case of the de facto complainant is that she obtained loan from the petitioner to meet the expenses of the marriage of her daughter and issued signed empty cheques and promissory notes to him, and even after she repaid the entire amount along with interest, the petitioner without returning the blank signed cheques and promissory notes, harassing the de facto complainant and when she asked him to return the same, he abused her in filthy language and threatened her with dire consequences.

The allegations alleged against the petitioners are so serious in nature and hence, this Court is not inclined to interfere with the investigation at the threshold.

The Criminal Petition is dismissed accordingly. Miscellaneous petitions pending if any, shall stand closed. ______________ RAJA ELANGO, J February 25, 2016.
