THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.7538 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.1 in Crime No.410 of 2023, on the file of Gachibowli Police Station, Hyderabad, registered for the offence under Section 8(c) r/w. 20(b) (ii) (c) of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NPDS Act').

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondentState and perused the record. 3.

On 23.03.2023, the Detective Inspector of Police, Gachibowli having received the information regarding ganja being stored in a house, went and searched the said premises bearing Door No.2-88/2, Nanakramguda Village, Serilingampally Mandal, Ranga Reddy District. In the said premises, this petitioner was found and he

has shown the ganja which was in the house to the independent mediators. Having followed the procedure prescribed under NDPS Act, ganja weighing 20 kgs. 900 gms was seized.

According to the investigation, the premises was taken on rent by A-2 and lease deed was executed in his name. This petitioner was found in the premises and he has pointed out the ganja according to the Police. 5.

Learned counsel appearing for the petitioner would submit that he has nothing to do with the ganja that was seized and the Police have falsely implicated him. 6.

Keeping in view that the house was taken on rent by A-2, this petitioner can be granted relief of regular bail subject to following conditions:

i) The petitioner/Accused No.1 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties for a like sum each to the satisfaction of Special Sessions Judge for Fast Tracking the cases relating to Atrocities against Women-Cum-XIII Additional District & Sessions Judge-Cum-XIII Additional

Metropolitan Sessions Judge, R.R.District at L.B.Nagar.

ii) The petitioner/Accused No.1 after release shall appear before the Station House Officer, Gachibowli Police Station everyday for a period of four weeks and thereafter, as and when required, for the purpose of investigation.

iii) The petitioner/Accused No.1 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
