HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.17371 OF 2018 ORDER :

This Writ Petition is filed, seeking a writ of mandamus to declare the action of the respondent No.3 in continuing the petitioners' vehicle documents with fake address in spite of their representations and requests, as arbitrary, illegal and consequently to direct the respondent No.3 to change the addresses which are maintained by the financing bank.

Heard the arguments of Smt.M.Shalini, learned Counsel for the petitioners and learned Government Pleader for Transport appearing for the respondents.

It has been contended by the petitioners that the 3rd respondent is not renewing the fitness of the petitioners' vehicle, despite repeated requests and the action of the 3rd respondent is arbitrary and illegal. It has been further contended that the issue raised in this writ petition is squarely covered by the order in W.P.No.33497/2017 dated 06.10.2017 and prayed to pass similar orders in this Writ Petition also. The learned Government Pleader has not disputed the same. 5.

In view of the above, this Writ Petition is allowed in terms of the orders in Writ Petition No.33497/2017 dated 06.10.2017 and the respondents are directed to allow the petitioners forthwith to submit their application through online and upon such application being submitted by the petitioners, the respondents shall consider the same and pass appropriate orders within two weeks from the date of receipt of a copy of this order. There shall be no orders as to costs.
