THE HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.7474 of 2013 ORDER:

This writ petition is filed questioning the inaction on the part of the respondent Nos. 1 to 3 in not taking any steps to stop illegal constructions made by the respondent Nos. 4 to 6 in and over the premises bearing H.No.6-3-562 and 6-3-562/A/1, admeasuring 2102 square meters on the main road at Erramanzil, Somajiguda, Hyderabad, as illegal and arbitrary.

When the matter came up for admission on 13.3.2013, notice dated 18.1.2013 issued to the respondent Nos. 4 to 6 under Sections 452 (1) and 461(1) of Hyderabad Municipal Corporation Act, 1955 was placed before the Court calling upon the unofficial respondents to submit their representations and they were directed to stop the illegal constructions forthwith. Today when the matter came up for hearing, learned Standing Counsel for the official respondents 1 to 3 submits that even as per the latest instructions also notice has been issued to the unofficial respondents.

Heard learned counsel for the petitioners and learned Standing Counsel for the official respondents 1to 3. In view of the fact that notice has already been issued to the unofficial respondents under Sections 452 (1) and 461(1) of Hyderabad Municipal Corporation Act, 1955, the official respondents are directed to follow due process of law and pass appropriate orders, after giving an opportunity of hearing to the petitioners and unofficial respondents. The official respondents

are also directed to communicate the action taken by them to the petitioners.

Writ Petition is disposed of accordingly. No order as to costs.
