The Court made the following:

ORDER:

This Company Petition is filed for an order to wind up the respondent for non-payment of the debt due to the petitioner.

The learned counsel for the respondent filed Memo dated 7-2-2015 wherein he has stated that Banker's cheque bearing No.529984, dated 6-2-2015 drawn on State Bank of Hyderabad, Khairtabad branch, for Rs.1,60,175/- as full and final settlement of the outstanding dues was handed over to the petitioner. Along with the Memo, the respondent has filed a copy of receipt dated 6-2-2015 issued on behalf of the petitioner evincing receipt of the Banker's cheque. A copy of the Banker's cheque is also filed.

Mr. P.N. Sunil Kumar Reddy, learned counsel for the petitioner, has admitted receiving the of Banker's cheque by his client.

In view of the payment made by the respondent to the petitioner through the above mentioned Banker's cheque as full and final settlement of its liability, the Company Petition does not survive for adjudication and the same is accordingly closed.

As a sequel to the disposal of the Company Petition, Company Application Nos.1078, 1079 and 1080 of 2014 are disposed of as infructuous.
