HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.40046 OF 2015 ORDER:
The writ petition is filed questioning the proceedings dated 12.11.2015, issued by the respondents-Corporation rejecting the application of the petitioner.
When the matter is taken up for hearing, Sri Pratap Narayan Sanghi, learned counsel for the petitioner submits that inasmuch as the petitioner had complied with the conditions substantially though not in letter and sprit, no prejudice as such would be caused to the respondents-Corporation in allocating the distribution-ship to the petitioner as at any rate some one has to market the products of the respondents-Corporation. He further submits that the financial status of the petitioner is also sound and the debenture certificates which have been furnished by the petitioner at the time of application are encashable at any point of time and the petitioner is ready to provide the bank fixed deposits in place of the debenture certificates which were produced at the time of application. In that context, he points out the conditions laid down in the guidelines which provide for taking into consideration of the deposits with the listed companies apart from the bonds independently.
Learned counsel for the respondents-Corporation opposes the writ petition.
Having considered the revival submissions and considering the innocuous prayer which has been made by the petitioner and particularly in the facts and circumstances of the case, I am inclined to direct the respondents-Corporation to consider the representation dated 16.11.2015 made by the petitioner particularly keeping in view of the fact that ultimately some one or the other has to market the products of the respondents-Corporation and particularly considering
that as on the date no dealer was appointed for the notified area. With the above observations, the writ petition is disposed of. No order as to costs.
Miscellaneous Petitions pending, if any, in this writ petition shall stand closed.
