HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 36888 of 2015 ORDER:
Heard learned counsel for the petitioners and learned Government Pleader for Revenue. With the consent of both the parties, the main writ petition itself is heard at the admission stage.
The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the second respondent in not issuing "Occupancy Rights Certificate" in respect of 1/3rd share of the lands in Sy.No.1027, 1028, 1029, 1031, 1036, 1037 and 1039 situated at Nandigama Village, Kothur Mandal, Mahaboobnagar District, by considering his application in F.No.K/2946/2012, as illegal and arbitrary; and consequently direct the second respondent to consider the said application. Though various grounds are raised in the writ petition, learned counsel for the petitioners restricts his prayer seeking a direction to the second respondent to consider his application in F.No.K/2946 of 2012, which is pending since last three years.
Government Pleader for Revenue submits that such a direction may be given provided the application made by the petitioner is still pending consideration.
Without going into the merits of the case and having regard to the facts and circumstances of the case, the writ petition is disposed of, directing the second respondent to consider the application made by the petitioner for issuance of "Occupancy Rights Certificate" vide F.No.K/2946 of 2012, in accordance with law, within a period of twelve (12) weeks from the date of receipt a copy of this order, if the same is still pending consideration. No order as to costs.
Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
