THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION NO.1557 of 2016 ORDER:

The petitioners, who are A.3 and A.5, filed the present application under Section 482 Cr.P.C seeking to relax the conditions imposed by the learned V Additional Sessions Judge, Bhongir vide order, dated 12.01.2016, in Crl.M.P.No.1194 of 2015 in Crime No.303 of 2015.

2. Heard.

The learned V Additional Sessions Judge, Bhongir while granting bail to the petitioners/A.3 and A.5 imposed the following condition: "The petitioners/A.3 and A.5 are further directed to appear before the SHO concerned at 10:00 A.M. to 11:00 A.M. till the charge sheet is filed in order to cooperate with the investigation they shall not influence or tamper the prosecution witnesses in any manner."

4. On instruction, learned Public Prosecutor, submits that the petitioners have been complying with the direction imposed by the Court below. He further submits that the investigation is completed, but charge sheet is not yet filed.

Having regard to the facts and circumstances of the case and since the charge sheet is not yet filed, the petitioners/A.3 and A.5 shall appear before the Station House Officer concerned on every Sunday between 10:00 A.M., and 5:00 P.M., instead of appearing everyday as directed by the Court below, for a period of four (4) weeks or till filing of charge sheet, whichever is earlier. The other conditions imposed by the Court below shall remain undisturbed.

Accordingly, the Criminal Petition is allowed modifying the impugned order.
