THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 20383 of 2019 ORDER:
This Writ Petition is filed for the following relief: "For the reasons stated in the accompanying affidavit, it is therefore prayed this Hon'ble may be pleased to issue a Writ or order or direction, more particularly one in the nature of Writ of Mandamus, declaring the high-handed action of the 3rd & 4th respondents in trying to demolish and dispossess petitioner house site Plot bearing No.49 in Survey Number 329/1 of Gajularamaram Village, Qutbullapur Circle & Mandal, Medchal-Malkajgiri District, without following the due process of law and in not issuing any sort of valid notice of whatsoever to the petitioner, the same being illegal, irregular, irrational without jurisdiction and in violation of Articles 14, 21 and 300-A of Constitution of India, and consequently direct the respondents not to demolish and dispossess the petitioner house site petitioner house site house site plot bearing No.49 in Survey Number 329/1 of Gajularamaram Village, Qutbullapur Circle & Mandal, Medchal-Malkajgiri District."
When the matter is taken up, it is submitted by the learned counsel for the petitioner that the issue in the present Writ Petition is squarely covered by the common order dated 05.03.2019 passed by this Court in Writ Petition No.42584 of 2018 and batch.
CKR, J W.P.No.20383 of 2019 Learned Government Pleader for Revenue does not dispute the aforesaid submission.
Relevant portion of the aforesaid common order reads as under:
"In that view of the matter, all these Writ Petitions are disposed of directing the revenue authorities not to interfere with the possession and enjoyment of the petitioners over the subject plots except in accordance with the procedure laid down by law, in such of the cases where interference is warranted.
In the light of this final order, the status quo orders granted in all these Writ Petitions shall stand vacated." In those circumstances, following the above said common order and for the reasons recorded therein, this Writ Petition is also disposed of in terms thereof.
Office to annex a copy of the common order dated 05.03.2019 passed by this Court in Writ Petition No.42584 of 2018 and batch to this order.
Miscellaneous Petitions, if any pending, shall stand closed. There shall be no order as to costs.
