M Raja Shekar Reddy , Raja Reddy v. The State Of Andhra Pradesh
THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO WRIT PETITION No.17398 OF 2018 ORDER:
In this writ petition, the petitioner seeks a Writ of Mandamus declaring the action of the second respondent in not extending the period to conduct the Exhibition with Amusement Park in P.W.D. Grounds at Vijayawada from 16.05.2018 to 28.05.2018 as illegal and arbitrary, and consequently to direct the second respondent to extend the period to conduct the Exhibition from 16.05.2018 to 28.05.2018 2) Learned Government Pleader for Revenue (AP) takes notice for the respondents.
3) Heard.
4) The submission of learned counsel for the petitioner is that on 20.04.2018, the petitioner could not conduct the Exhibition due to Bandh call given for 'Dharma Porata Deeksha' by the Hon'ble Chief Minister of State of Andhra Pradesh and thereafter the petitioner could not conduct the Exhibition also from 01.05.2018 to 03.05.2018 due to sudden storm and collapse of some stalls. For the aforesaid reason, learned counsel would argue, it is just and proper on the part of the respondent Authorities to extend the time from 16.05.2018 to 28.05.2018, but the respondent Authorities have refused to extend the time.
5) Per contra, learned Government Pleader for the respondents would submit that P.W.D. Grounds were already booked by Sri S.S.Reddy from 16.05.2018 to 23.05.2018 and by Sri G.N.Chowdary from 24.05.2018 to 22.06.2018 for holding different programmes and therefore, the respondent-Authorities cannot extend the period.
6) It is seen that in the order vide Reference File No.REVESECOLEA//1/2018-SA-(E2)-KCO, dated .03.2018, there is no mention that in case the petitioner is unable to hold the Exhibition due to any unforeseen situations, the time will be extended proportionately. Hence, the petitioner cannot claim any right to seek extension of time, though for genuine reasons he could not hold the Exhibition as submitted by him. Having found no merits, the Writ Petition is dismissed. Consequently, miscellaneous petitions, if any pending in the writ petition, shall stand closed.
