THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.7317 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.1 in Crime No.222 of 2023, on the file of W.P.S., Saroornagar, Rachakonda, registered for the offences under Sections 498-A, 406, 506 and 504 r/w. 34 of IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The petitioner was arrested on the basis of the complaint filed by his wife. It is alleged that they were married on 11.08.2022. A-2 called this petitioner for baby shower function. However, when the de-facto complainant asked the petitioner to stay back, he slapped her. Thereafter, several incidents were narrated alleging that money was demanded for purchase of plot at Gachibowli and
also he has caused mental torture. It is also alleged that petitioner tried to strangulate her neck and took a kitchen knife to stab her. However, she escaped.

As seen from the complaint, there are differences between the spouses and it is alleged that the petitioner was harassing her. However, learned Additional Public Prosecutor on instructions submits that no injuries were received by the de-facto complainant. Keeping in view that this petitioner is lodged in jail from 13.07.2023, he can be granted relief of regular bail subject to following conditions: i) The petitioner/Accused No.1 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties for a like sum each to the satisfaction of III Additional Metropolitan Magistrate at L.B.Nagar, Cyberabad.
ii) The petitioner after release shall appear before the concerned Station House Officer everyday for a period of thirty days at 10.00 AM and thereafter as and when required, for the purpose of investigation. iii) Any attempt by the petitioner to go near the de-facto complainant or contact her in any manner would entail cancellation of bail granted.
(iv) The petitioner/Accused No.1 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.
Miscellaneous applications, pending if any, shall stand closed.
