THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37410 of 2016 ORDER:

In this writ petition, the petitioner seeks a direction to respondents 2 & 3 not to evict her from the land to an extent of Ac.3.00 cents in Sy.NO.9/3c, situated in Appanapalem Village of Sarabhavaram Gram Panchayat of Rajavommangi Mandal, East Godavari District without following due process of law.

The petitioner alleges that the respondents 2 and 3 have been trying to dispossess her from the land in question without issuing any notice or initiating eviction proceedings at the instance of 4th respondent herein. On the other hand, the learned Government Pleader submits that the petitioner is not in possession of the land in question. Heard and perused the material available on record. Considering the grievance of the petitioner, without expressing any opinion regarding the possession of the petitioner over the land in question, if the petitioner is in possession of land as alleged, the respondents 2 & 3 are hereby directed not to dispossess the petitioner from the said land without following the due process of law. With the above direction, the writ petition is disposed of. No order as to costs.
