HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CIVIL REVISION PETITION No.4822 of 2015 ORDER:

The grievance of petitioner, who is plaintiff in O.S.No. 20 of 2012 on the file of Senior Civil Judge, Rajam, who filed the said suit for partition of plaint schedule properties is that he filed I.A.No. 12 of 2015 under Order VII Rule 14 CPC, praying the trial Court to receive the documents listed in that petition and mark them as exhibits on behalf of the plaintiff, but the trial Court has not been disposing of the said petition though counter was filed by the other side and matter has been coming on since long.

As can be seen from the submission of the petitioner, there is no order impugned in the instant case to warrant the interference of this Court in the Civil Revision Petition. Learned counsel only prays for intervention of this Court for giving a direction to the trial Court for early disposal of I.A.No. 12 of 2015. It is seen that I.A.No. 12 of 2015 was filed in January 2015 and the certified copy of the docket order shows that it has been adjourned from time to time for arguments of respondents. The suit is of the year 2012, which needs early disposal.

Under these circumstances, while dismissing the Civil Revision Petition, the trial Court is directed to dispose of I.A.No. 12 of 2015 on merits, within one month from the date of receipt of a copy of this order.

As a sequel thereto, miscellaneous applications, pending if any, shall stand closed.
