HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S.V. BHATT P.I.L.No.207 OF 2012 PC: (Per the Hon'ble Sri Justice S.V.Bhatt) Heard Smt.B.Rachana, learned counsel for petitioner and the Special Government Pleaders for the States of Telangana and A.P for respondents.

The petitioner prays for the following relief: ".....this Hon'ble Court may be pleased to issue a Writ of Mandamus to call for the remarks from the respondents herein relating to the sale of whitener fluid, thinner and gum stick to the children especially in the Nellore District and to direct the Respondents herein to ensure that the sale of such substances to the children is prevented since inhaling of such substances is deleterious to the health and proper growth of the children affecting their fundamental right to pollution free environment and to pass..........".

At the instance of respondents, the PIL has undergone a few adjournments and respondent Nos.1 and 2 have filed counter affidavits. The respondents, while admitting a few pernicious effects with free sale of whitener and thinner, have expressed difficulty in regulating the sale of whitener/thinner in the absence of legislative measures. Learned counsel for the petitioner requests the Court to permit the petitioner to approach the competent authority/forum for appropriate reliefs, including prevailing upon the necessity of putting in place proper mechanism for regulating sale of whitener/ thinner by retail vendors. The request of petitioner is placed on record.

The authorities, we hope and trust, will look into the representation of petitioner and take appropriate measures to address the problem arising from free sale of whitener/thinner. The petitioner is given liberty to pursue all the authorities for relief, to put in place mechanism to regulate sale of whitener and thinner.
