Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies. The Writ Petition is being disposed of at the stage of admission with the consent of parties.

The petitioner was appointed as a fair price shop dealer of shop No.1, Tangutur Village, Tangutur Mandal, Prakasam District. On the report of the Food Inspector, Ongole-I, 6-A proceedings were initiated against the petitioner. Simultaneously, a show cause notice was issued by the third respondent on 26.02.2015. The petitioner submitted his explanation on 05.03.2015. After considering his explanation, the third respondent passed the impugned order on 18.05.2015 cancelling the authorization of the petitioner. Challenging the said proceedings, the present Writ Petition is filed. Now, it is claimed on record that the petitioner preferred an appeal to the second respondent against the impugned order, along with a stay petition, on 01.06.2015.

In view of the nature of the final order, and the allegation contained therein, this Court is not inclined to entertain the Writ Petition at this stage. However, since the petitioner had already preferred an appeal to the second respondent, the second respondent is directed to consider the stay petition first, and pass appropriate orders, within a period of one week from the date of receipt of a copy of this order. Later, the second respondent shall take up the substantive appeal, consider and dispose of the same within a period of ninety days from the date of receipt of a copy of this order. The Writ Petition is, accordingly, disposed of at the stage of admission. Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of. No order as to costs.
