HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.41227 of 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is preferred by the petitioner seeking to declare the action of the 2nd respondent in passing the impugned order vide proceedings No.B/1061/2016 dated 21.06.2016, as illegal and arbitrary. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue for respondents 1 to 3. With their consent, the writ petition is disposed of at the admission stage itself. There is no necessity to put respondent No.4 on notice since this Court is not venturing to adjudicate the case on merits. In this writ petition the learned counsel for the petitioner challenges the proceedings dated 21.06.2016 passed by the 2nd respondent. In that view of the matter, the appropriate remedy available to the petitioner would be to file an appeal against the proceedings of the 2nd respondent. Hence, the Writ Petition is disposed of giving liberty to the petitioner to avail the alternative remedy of appeal challenging the proceedings No.B/1061/2016 dated 21.06.2016, in accordance with law.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. No order as to costs.
