THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WP.No.39756 of 2016 O R D E R:

Petitioner had filed this Writ Petition challenging the order dt.05.03.1996 passed by the 1st respondent removing him from service and the consequential order dt.26.08.1996 passed by the 1st respondent surrendering the petitioner to the 3rd respondent.

Thus the petitioner seeks to revive a dispute of 20 years old.

Counsel for the petitioner submits that the 3rd respondent orally informed the petitioner that he would consider the case of the petitioner after the petitioner is acquitted in the criminal case and the petitioner was acquitted in the said criminal case in 2016 only and that is why there is delay on the part of the petitioner in approaching the Court.

The basis on which the petitioner has questioned the order dt.05.03.2016 and the consequential proceedings dt.26.08.1996 is that there is no enquiry preceding the termination of the petitioner's services and it is violative of principles of natural justice.

I am of the opinion that the reason given by the petitioner for failure to challenge the order removing him from service cannot be accepted and the petitioner cannot be allowed to agitate a stale claim 20 years old now.

Therefore, I am not inclined to entertain this Writ Petition, since it suffers from grave latches and accordingly, it is dismissed. There shall be no order as to costs. 7.

Consequently, miscellaneous petitions pending, if any, in this Writ Petition shall stand closed.
