HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.35470 OF 2012 ORDER:

In this writ petition, the action of the respondents in terminating the licence of the petitioner vide proceedings dated 29.10.2012, is under challenge.

When the matter is taken up for hearing, counsel for the petitioner contended that the petitioner was granted licence for running cycle and scooter stand at City Bus Station, Hanamkonda for a period of four years commencing from 18.02.2012 till 17.02.2016, and this Court granted interim orders on 21.11.2012 stating that if any notification is issued for grant of licence for running the cycle and scooter stand, which is subject matter of the impugned proceedings dated 29.10.2012, the same shall not be finalised, pending further orders. Learned counsel for the petitioner further contended that by virtue of interim orders, the petitioner was continued to run the cycle and scooter stand at City Bus Station, Hanamkonda.

Standing Counsel appearing for the respondents had contended that even as per the admitted facts of the petitioner, the licence granted in favour of the petitioner was valid only upto 17.02.2016 and the petitioner has no right to squat on the subject premises beyond the said date. Therefore, the cause in the writ petition does not survive for adjudication and the writ petition may be closed.

However, if the petitioner intends to apply for fresh licence, it is always open to him to do so in accordance with the Rules and it is needless to say that the respondents shall consider the same and pass appropriate orders in accordance with law. The petitioner is also at liberty to submit a fresh representation seeking refund of the security deposit, within two weeks from the date of receipt of a copy of this order. Upon such representation being received, the respondents shall consider the same and pass appropriate orders in accordance with law. No order as to costs.
