HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 36662 of 2012 Order:

This Writ Petition is filed for the following relief. "To declare the inaction of the 4th and 5th respondents herein encouraging the trespassers/third parties/unsuccessful defendants in OS No.178 of 1997 on the file of Junior Civil Judge, Punganur, by ignoring the complaint of the petitioner dated 28.09.2012 to stop them in the light of the orders passed in OEP No.88 of 2007 delivering the possession to the petitioner to an extent of 0.39 cents in Survey Nos.8/2 (0.21 cents) in Patta No.176, 8/5 (0.18 cents) in Patta No.523 of Jangalapalli village of Melumdoddi revenue village of Punganur Mandal, Chittoor District, is bad, illegal, arbitrary and unconstitutional and further declare that the petitioner purchased the said land of 0.39 cents out of Ac.1.

48 1⁄2 cents in eight different survey numbers through a public auction conducted by the District Munsif Court, Madanapalle in OEP No.83 of 1971, dated 06.06.1975, and delivered the possession to the petitioner through a court order after partition in EP No.88 of 2007 and consequently direct the 4th and 5th respondents herein to give police aid to the petitioner."

2. When the matter is taken up for hearing, learned counsel for the petitioner submits that pursuant to the orders in EP No.88 of 2007 in OS No.178 of 1997, the possession of the property was delivered to the petitioner.

3. In view of delivery of possession of the property in favour of the petitioner, the cause of action in the Writ Petition does not survive and the Writ Petition is, accordingly, closed. There shall be no order as to costs.

4. As a sequel thereto, the miscellaneous petitions, if any, pending

in this Writ Petition shall stand closed.
