HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S.V. BHATT WRIT APPEAL No. 1503 of 2005 ORDER: (per the Hon'ble Sri Justice S.V.Bhatt) The writ appeal is directed against the order, dated 11.03.2005, in W.P.No.8327 of 1999. Writ petitioner is the appellant. The appellant unsuccessfully challenged the show cause notice Roc.No.E4/17213/1998, dated 22.03.1999, issued by the District Collector-respondent No.1 proposing to cancel the assignment and resume possession of the land.
From the docket proceedings, it is evident that this Court while admitting the appeal, did not grant order of stay or suspension of the notice, dated 22.03.1999. At the time of hearing, it is brought to our notice that respondent No.1, through proceedings D.Dis.No.E5/7213/1998, dated 22.12.2006, had passed final orders cancelling the assignment in favour of the appellant. Having regard to the subsequent development, we are not inclined to examine the merits in the writ appeal.
The writ appeal is accordingly dismissed. The appellant is given liberty to pursue remedies available in law against the order, dated 22.12.2006, if so advised.
Consequently, miscellaneous petitions, if any, also stand disposed of. There shall be no order as to costs.
