THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.41101 OF 2015 ORDER:

Heard learned counsel for the petitioner, and learned Government Pleader for Medical and Health and learned Standing Counsel for respondent No.2.

The petitioner, who is party-in-person, states that he underwent open heart surgery and is a White Card Holder. He states that the facility of getting medicines has not been extended to him from the nearest Primary Health Centre or the Government Civil Dispensary located within the premises of the High Court. Complaining the action of the respondents in not providing medicines as prescribed by the Doctors at High Court Dispensary, the petitioner made a representation, dated 20.11.2015, to the Principal Secretary, Medical and Health Department, Secretariat, Telangana State, Hyderabad, the 1st respondent, and alleging inaction on his part, the present Writ Petition is filed.

Learned Government Pleader for Medical and Health, on instructions, submits that the High Court Dispensary is not covered under Arogya Sree Scheme and the petitioner is entitled to approach appropriate hospital or dispensary.

The petitioner states that he might be given liberty to approach any other convenient Hospital or Civil Dispensary of the State to avail the benefit of getting medicines.

The Writ Petition is accordingly disposed of giving liberty to the petitioner to approach the appropriate Civil Dispensary or Hospital for getting the medicines. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
