HIGH COURT FOR THE STATE OF TELANGANA THE HON'BLE THE CHIEF JUSTICE SRI RAGHVENDRA SINGH CHAUHAN AND THE HON'BLE SRI JUSTICE A. ABHISHEK REDDY WRIT PETITION No.20395 of 2019 20.09.2019 Between:
Kukde Nousheen
...Petitioner
and The State of Telangana and others
...Respondents
Counsel for the Petitioner: Mr. G. Rajeshwar Rao Counsel for the respondents : Mr. S. Santhosh Kumar, Special Government Pleader The Court made the following:
HCJ&AAR,J W.P.No.20395 of 2019 ORDER: (Per the Hon'ble the Chief Justice Sri Raghvendra Singh Chauhan) The present Habeas Corpus Writ Petition has been filed, ostensibly, on the ground that the petitioner's husband, Kukde Sai Krishna, is being illegally detained by his father, Kukde Satyanarayana, the respondent No.6.
In compliance of the order dated 18.09.2019, the Station House Officer, Penchikalpet, the respondent No.4, has produced the detenu before this Court.
This Court has spoken to Mr. Kukde Sai Krishna. He informs this Court that he left his matrimonial home, out of his own volition, in order to seek out some work, by which he could support his family. He had gone to Visakhapatnam to look for a job. Recently, he is employed at Visakhapatnam in Airtel Company. He states that as soon as he settles down in Visakhapatnam, hopefully within a period of one month, he will be willing to take the petitioner, his wife, with him to Visakhapatnam. Since the detenu happens to be a major and wants to go back to Visakhapatnam to continue his job, this Court does not find any merit in the present Habeas Corpus Writ Petition; it is hereby dismissed. There shall be no order as to costs.
The miscellaneous petitions pending, if any, shall stand closed. _____________________________ RAGHVENDRA SINGH CHAUHAN, CJ ____________________ A. ABHISHEK REDDY, J 20th September, 2019 JSU
