Heard.

2. Petitioner is an existing fair price shop dealer at Kallur Village, Lepakshi Mandal. While petitioner is working as a dealer since 1990, in the year 2006 his authorization was suspended on the basis of some allegations. Petitioner, however, submitted a detailed reply and respondent No.4 restored the petitioner's authorization by imposing a penalty along with severe warning. Aggrieved by the same, respondent No.6, who was temporarily appointed, has approached respondent No.3 in an appeal and respondent No.3 by order dated 14.07.2014 allowed the said appeal. Aggrieved thereby, petitioner preferred further revision before the District Collector and District

Magistrate, respondent No.2 herein. Respondent No.2 by order, dated 18.08.2014, impugned herein, while calling for the records has declined to grant stay. Aggrieved thereby, petitioner preferred this writ petition.

3. The facts and circumstances noticed above show that the irregularities alleged against the petitioner were condoned by restoring his authorization subject to the penalty. However, that order was interfered with by the Joint Collector and is now subject matter of revision before respondent No.2Collector.

4. Keeping in view all the circumstances, therefore, respondent No.2 is directed to hear and decide the appeal aforesaid, in accordance with law, and pass final orders preferably within four weeks from the date of receipt of a copy of this order.

With the above direction, the writ petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
