When the matter is taken up for hearing, learned counsel for the petitioner submits that the respondents have rejected the case of the petitioner for compassionate appointment vide proceedings dated 03.02.2003 on the ground that the petitioner is adopted son of the deceased employee. He contends that appropriate orders be passed directing the respondents to consider the case of the petitioner for compassionate appointment.

Learned standing counsel for the respondent corporation has contended that as per the regulations of the respondent corporation, the adopted son of the deceased employee is not entitled for compassionate appointment and the writ petition is devoid of merits and the same is liable to be dismissed.

Having considered the rival submissions made by the learned counsel on either side, this Court is of the considered view that the relief sought for by the petitioner cannot be granted as the adopted son of deceased employee is not entitled for compassionate appointment as per the regulations of the respondent corporation. I find no merits in the writ petition and the same is liable to be dismissed.

Accordingly, the writ petition is dismissed. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs.
