HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.17457 of 2018 ORDER:

This Writ Petition is filed seeking Writ of Mandamus declaring the action of the respondents in not approving the names of Devanatham M and Arutselvan K for the post of Assistant Professor despite having necessary qualifications of M.Tech.(VLSI Design) as prescribed in G.O.Ms.No.14, Higher Education (UE.II) Department, dated:20-2-2010 before 15.5.2018 ie., the last date for grant of affiliation as arbitrary and illegal and to pass appropriate orders. 2.

Heard Sri S. Satyam Reddy, the learned Senior Counsel for petitioner and Sri Abhishek Reddy, Counsel for respondent No.2. 3.

It is contended by the senior Counsel appearing for the petitioner that the faculty appointed by the petitioner College is not being approved by respondent No.2 on the ground that the candidates are not having requisite qualification as per the AICTE guidelines. Whereas, candidates are having M.Tech (VLSI Design) as prescribed in G.O.Ms.No.14, Higher Education (UE.II) Department, dated:20.2.2010.

The learned Standing Counsel appearing for respondent No.2 has contended that the qualifications possessed by the candidates are not as per AICTE guidelines.

The learned senior Counsel further submitted that the two candidates for the posts of Assistant Professor submitted a representation dated:5.5.2018 requesting the respondent No.2 to approve their appointment by the petitioner college as per G.O.Ms.No.14, Higher Education (UE.II) Department, dated:20.2.2010 and the respondent No.2 is not considering the said representation and the same is pending with the respondent No.2. 6.

Having considered the submissions made by the rival parties, this Court is of the considered view that ends of justice would be met if the writ petition is disposed of directing the respondent No.2 to dispose of the representation dated:5.5.2018 made by the candidates, in terms of G.O.Ms.No.14, Higher Education (UE.II) Department, dated:20.2.2010, and pass appropriate orders, within one week from the date of receipt of copy of this Order.

Accordingly, the Writ Petition is disposed of. Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed.
