THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.31713 of 2017 ORDER:

This Writ Petition is filed challenging the notice dated 05.09.2017 directing the petitioners to remove the encroachments allegedly made by the petitioners in Survey Nos.92 and 93 by occupying the road portion.

Learned Counsel for the petitioners submits that no marking is done in the land of the petitioners in order to understand the extent of encroachment and hence the present notice is irregular. But, a reading of the notice clearly shows that a sketch was submitted in the PLC No.91 of 2017 before the Court of learned VI Additional District Judge, Gooty, and in view of the same and in view of the title deeds possessed by the petitioners, the petitioners should have been in a position to understand the extent of encroachment.

In view of the above, it is open to the petitioners to remove the encroachment based on the understanding of their title deeds and if the petitioners are in doubt, they can submit a representation to the third respondent within one week from the date of receipt of a copy of this order, and on receipt of the same, the third respondent shall take appropriate action after considering the representation of the petitioners.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 18.09.2017 vs
