HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2090 OF 2016 ORDER:
This criminal petition is filed by the petitioner-A1 to quash the proceedings in C.C.No.1211 of 2015 on the file of Additional Judicial Magistrate of First Class, Tiruvuru, Krishna District. Heard and perused the material available on record. The offences alleged against the petitioner are punishable under Sections 455, 448 and 323 r/w. 34 IPC. The allegations against the petitioner are that she tried to evict the de facto complainant from his house forcibly with the help of the other accused and also threatened the de facto complainant with dire consequences. After arguing for some time, learned counsel for the petitioner, while not pressing for the main prayer, confined his arguments only to the extent of dispensing with the presence of the petitioner before the trial Court.
In view of the submission of the learned counsel for the petitioner, the presence of the petitioner before the trial Court is dispensed with except on the dates on which the learned trial Judge insists for her presence and she shall be properly represented through her counsel before the trial Court.
Accordingly, the Criminal Petition is disposed of. Miscellaneous petitions pending if any, shall stand closed. ______________ RAJA ELANGO, J February 19, 2016.
