THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.5508 of 2018 ORDER:

This criminal petition is filed, by the petitioner/accused No.7 under Section 482 Cr.P.C., to suspend the Non-Bailable Warrant issued against her.

Heard learned counsel for the petitioner and perused the record. A perusal of the record reveals that the petitioner herein along with others filed Crl.P.No.4924 of 2018. This Court, while disposing of the said Criminal Petition, directed the petitioner and others to appear before the trial Court on or before 10.05.2018 and move an application for recall of the NBWs issued against them.

Learned counsel for the petitioner submitted that the petitioner was admitted in the hospital on 04.05.2018 due to advance stage of pregnancy.

The petitioner could not attend before the trial Court as directed by this Court due to the reasons beyond her control. Taking into consideration the peculiar facts and circumstances of the case, the petitioner/A.7 is directed to appear before the trial Court on or before 15.06.2018 and file an application for recall of NBWs issued against her. The trial Court is hereby directed to dispose of the application, if any, filed by the petitioner, under Section 70 (2) Cr.P.C on the same day and in accordance with law.
