THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3508 OF 2016 ORDER:

This petition is filed by the petitioner under Section 482 Cr.P.C. seeking to quash the proceedings against him in C.C.No.270 of 2015 on the file of the IV Additional Judicial First Class Magistrate, Kakinada.

Heard and perused the material available on record. The petitioner is alleged to have committed the offence punishable under Sections 420, 468, 469 and 471 r/w 34 IPC. It is alleged that A2 to A4 with the active connivance of A1, who was the then Joint Secretary of A.P. Olympic Association created fake and illegal letters of affiliation and submitted them to Indian Weight Lifting Federation and that A2 to A4 are degrading the association of the complainant and trying to promote their sport persons without having any right.

Considering the facts and circumstances of the case and the allegations made in the charge sheet, this Court is not inclined to interfere with the proceedings in the above case. At this stage, the learned Counsel for the petitioner prayed for dispensing with the presence of the petitioner before the trial Court. In view of the above submission, the presence of the petitioner before the trial Court is dispensed with except on the dates when his presence is specifically insisted by the trial Court. The petitioner shall be represented by a Counsel before the trial Court on all hearing dates.

Accordingly, the Criminal Petition is disposed of. Consequently,
