THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.1025 OF 2017 ORDER:

The writ petition is filed by the petitioner/complainant seeking a writ of mandamus declaring the action of the third respondent in filing the charge sheet against Vemula Rambabu and Perumalla Ramesh Goud only and in not filing the charge sheet against Akarapu Venkanna and brother of Vemula Rambabu, though in the complaint dated 29.10.2014, it is clearly mentioned about the involvement of those persons, as illegal and arbitrary, and consequently to direct the third respondent to investigate into the matter and take appropriate steps. Heard and perused the material.

Learned counsel for the petitioner/complainant submits that the petitioner lodged a complaint alleging that when the petitioner after dropping her daughter at Dental College, reached varnicross road, the accused, namely, Vemula Rambabu, Perumalla Ramesh, Akarapu Venkanna and brother of Vemula Rambabu came in a car, stopped the vehicle and dragged the petitioner and bet him with hands and threatened him with dire consequences and asked him to return their amount. However, the third respondent has filed charge sheet against A.1 and A.2., i.e., Vemula Rambabu and Perumalla Ramesh only and in the charge sheet, it is stated that the offence not established against Akarapu Venkanna and brother of Vemula Rambabu. He further submits that the third respondent has not properly investigated into the crime and as such, prays this Court to direct the third respondent to properly investigate the case.

Considering the facts and circumstances of the case, the third respondent is directed to conduct thorough investigation and file charge sheet, if any, against Akarapu Venkanna and brother of Vemula Rambabu, in accordance with law.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 06.01.2017 pln
