THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No.1721 of 2016 ORDER:

This Contempt Case is filed against the respondents alleging violation of order, dated 20.03.2015 passed by this Court in WPMP.No.8642 of 2015 in Writ Petition No.6505 of 2015. By the aforesaid order, this Court directed both the parties to maintain status quo as on date until further orders. In the case on hand, it is the complaint of the petitioner that after passing the said interim order, constructions have been made in plot No.71 (part) and plot No.72 in the layout of KGR Enclave situated at Ameenpur Village, Patancheru Mandal, Medak District.

It is to be noted that today, by a separate order, the aforesaid Writ Petition came to be closed as it is not possible for this Court to come to a conclusion that whether the respondents have encroached into the petitioner's land or not. Likewise, in the case on hand, it is not possible for this Court to record a finding that the constructions were carried out in the land allotted to TSPDCL by the respondents. It is also to be noted that though it

CKR, J C.C.No.1721 of 2016 is alleged that the constructions are being made in the land allotted to TSPDCL, the said TSPDCL is not a party to the Writ Petition.

In those circumstances, this Court cannot presume that there is any violation on the part of the respondents in complying with the order of this Court.

Accordingly, the Contempt Case is closed.
