THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.7342 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioner/Accused No.1 seeking anticipatory bail in the event of his arrest in connection with Crime.No.403 of 2023 on the file of Chandrayangutta Police Station, Hyderabad, registered for the offence under Section 307 r/w. 34 of IPC. 2.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

Briefly, the case of the Police is that the petitioner's group and the injured group have entered into a free fight resulting in injuries to the persons in both the groups. Both the groups belong to one family.

On instructions, learned Additional Public Prosecutor would submit that all of them belong to one family. The complainant is not assisting the prosecution. It appears that he is not interested in prosecuting the case.

Learned counsel for the petitioner submits that the Police have suo-moto registered a case, no complaint was made by the injured.

Keeping in view, the injured was already discharged and further, the disputes are in between the persons of the same family, the petitioner can be granted bail, subject to the following conditions:-

1) The petitioner/Accused No.1 is directed to surrender before the Station House Officer, Chandrayangutta Police Station, Hyderabad on 23.08.2023. Upon such surrender, the said Station House Officer shall release the petitioner/Accused No.1 on bail, on his executing personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioner/Accused No.1 shall appear before the concerned Police everyday at 10:00 a.m. till 04.09.2023 and thereafter, as and when required for the purpose of investigation.

3) The petitioner/Accused No.1 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
