479 of 2013 passed by the Court of Special Sessions Judge for SC/ST (POA) Act, 1989-cum-Additional District and Sessions Judge, Ranga Reddy District at L.B. Nagar, dismissing the application filed by the plaintiffs under Order 39 Rules 1 and 2 of C.P.C., seeking interim injunction restraining the respondents/defendants from changing the nature of the petition schedule properties. 2. The appellant/plaintiff No.2 along with plaintiff No.1 has filed suit in O.S.No.479 of 2013 for declaration of title and recovery of possession of the suit schedule properties mentioned in Schedule 'A' and 'B'. Schedule 'A' consists of Plot No.17/1 admeasuring 500 square yards or 418 square meters forming part of Sy.Nos.

175 to 179 of Sri Prabhupada Township, situated at Kondapur Village, Serilingampally Mandal, Ranga Reddy District; and Schedule 'B' consists of Plot No.15 admeasuring 377.78 square yards or 315.8 square meters in Sy.Nos.175 to 179 of Sri Prabhupada Township, situated at Kondapur Village, Serilingampally Mandal, Ranga Reddy District. With regard to the very same suit schedule properties, there is another decree dated 3.12.2008 in favour of respondents/defendant Nos.1 to 3 in O.S.Nos.784 and 789 of 2002 passed by the Principal Senior Civil Judge, Ranga Reddy District. The plaintiffs, apart from seeking declaration of title over the suit schedule properties, also sought to declare the earlier judgment and decree dated 3.12.2008 in O.S.Nos.784 and 789 of 2002 as illegal and not binding on them.

Pending disposal of the suit, the plaintiffs have filed I.A.No.1165 of 2013 under Order 39 Rules 1 and 2 of C.P.C., seeking interim injunction restraining the respondents/defendants from changing the nature of the petition schedule properties. After considering the evidence and the material on record, the Court below has dismissed the said application through the impugned order dated 5.8.2014, categorically stating that the plaintiffs have not filed any layout showing the plots, on the other hand, the photographs filed by the defendants show that a huge building was constructed. Hence, the present appeal. 3. During the course of hearing, it is fairly submitted by Ms. J. Bhagyalakshmi, learned counsel for the appellant/plaintiff No.

2 that though the plaintiffs have filed application for grant of ad-interim injunction, as the Presiding Officer was not posted for a long time, there was a delay in prosecuting the matter and, in the meantime, constructions have come up. 4. Having heard Ms. J. Bhagyalakshmi, learned counsel appearing for the appellant/plaintiff No.2, and Sri Vedula Venkata Ramana, learned Senior Counsel, representing M/s. Bharadwaj Associates, learned counsel appearing for respondents/defendant Nos.1 to 3, we have perused the impugned order and the material on record. 5. From a perusal of the photographs filed before the Court below, it is clear that huge constructions have come up on the suit schedule properties.

In view of the admitted position, as there is a huge building on the suit schedule properties, the question of granting injunction restraining the respondents/defendants from changing the nature of the petition schedule properties does not arise. Further, as the appellant/plaintiff No.2 along with plaintiff No.1 is claiming title over the suit schedule properties, the same is a matter to be decided at the time of final disposal of the suit, after adducing evidence on both sides. 6. Therefore, having regard to the fact that even according to the case of the appellant/plaintiff No.2, constructions have already come up on the suit schedule properties, we are not inclined to grant any injunction, as prayed for, at this stage. 7. For the aforesaid reasons, this Civil Miscellaneous Appeal is dismissed.

However, as the suit is of the year 2013, the Court below is directed to dispose of the suit in accordance with law, as expeditiously as possible. As a sequel, miscellaneous petitions pending, if any, in this appeal shall stand closed. No order as to costs. ____________________________ JUSTICE R.
