Learned cr unsel for the State Government a s r.i,ell as the Telangana State Level Police Recruitment Board have rehemently argued before tL Ls Court that in case a person has not joined, the vacancy has to b: carried forward to the next selection. The facts < I the case make it very clear that it is not a case where appointm )nt orders were issued, persons have joined the post and persor s have left thereafter. Whetiter compliance of Rule 6-A of the Rules has been done or not has to be looked into in each and every individua.l case, The learned Singie Judge has a.lso gone to the extent in holding that the vacancies which are lying even after issuance of appointment orders, meaning thereby on account of non-joining of the candidates, are to be {illed up in accordance with Rule 6(A) of tl-re Rules. However, Rule 6 of the Rules provides that in case a candidate does not join pursuant to issuance of appointment order, the fallout vacancies, if any, due to relinquishment and non-joining of selected candidates shall be nolilied in the next recruitment. Therefore, to that extent, the order passed by the learned Single Judge is contrary to the statutory provisions as contained in Rule 6 ofthe Rules.

Resultantly, the order passed by the learrred Single Judge is set aside. The matter is remanded back to the writ court to deal with each. and every individual writ petition, in order to give a finding of fact whether Rule 6(A) of the Rules has been complied with or not. The parties sha-lI appear before the learned Single Judge on 29.10.2021. The learned Singie Judge is requested to decide the matters as expeditiously as possible, preferably urithin a period of thirty days from today, keeping in view the fact that t}te p"titiott"r" *" irr-tt it g against time and by efflux of time' their iight to the post will come to an end'

With the aJoresaid, the Writ Appeals stand disposed of' The miscellaneous applications pending in this writ appeal' if anv, sha1l stand closed."

i In the c rnsidered opinion of this Court, keeping in view the aforesaid judl;ment, once a vacancy is advertised and the vacancy .4 is unfiIled, ar the person in whose favour appointment order has been issued I.as not joined, the same cannot carry iorward to the next selectior L. The next person in the waiting iist should be appointed a lainst the vacancy. However, in cases where appointment orders were issued, persons have joined and left thereafter, th,:n the particular vacancies have to be carried forward to the next s:lection and therefore, this Court does not find any reason to in1 :rfere with the order passed by the learned Single Judge.

Accordir gly, the writ appeal is dismissed.
