THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.7364 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in Crime No.54 of 2023, on the file of Quthbullapur Police Station, Medchal-Malkajgiri District, registered for the offence under Section 8(c) r/w. 20(b) (ii) (c) of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NPDS Act').

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondentState and perused the record. 3.

The allegation against the petitioner is that she was found in possession of 1.7 kg. of dry ganja.

Learned counsel for the petitioner would submit that the quantity was little above the small quantity. She

was falsely implicated for the reason of pending cases against her. In fact, no seizure was effected. 5.

Learned Additional Public Prosecutor on instructions would submit that there are several cases pending against the petitioner for the very same offence. 6.

Keeping in view that the petitioner is a woman, a house wife and has to take care of her family, she can be granted relief of regular bail, more so, for the reason of contraband was little over the small quantity subject to following conditions:

i) The petitioner/Accused shall execute personal bond for a sum of Rs.20,000/- (Rupees Twenty thousand only) with two sureties for a like sum each to the satisfaction of Metropolitan Sessions Judge, Medchal-Malkajgiri District at Malkajgiri. ii) The petitioner after release shall appear before the concerned Station House Officer everyday for a period of one month at 10.00 AM and thereafter as and when required, for the purpose of investigation.

iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
