HON'BLE SRI JUSTICE M.S.K.JAISWAL Criminal Petition No.12107 of 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C., seeking to recall the Non-bailable Warrant issued against the petitioner herein, in C.C.No.1355 of 2007 on the file of IX Metropolitan Magistrate, Cyberabad.

Heard the learned counsel for petitioner and the learned Additional Public Prosecutor appearing for the State. Specific allegations were made against the petitioner in the complaint. The truth or otherwise of the allegations can only be decided during the course of trial. I see no grounds to interdict the proceedings at this stage.

In the facts and circumstances of the case and having perused the material available on record, the criminal petition is disposed of directing the petitioner/accused to approach the trial Court and file a petition under Section 70(2) of Cr.P.C. to recall the NBW issued against him and the same shall be disposed of on merits.

Miscellaneous petitions, if any, pending, shall stand closed.
