HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO W.P.No.17671 of 2018 ORDER:

This writ petition is filed under Article 226 of the Constitution of India. The petitioners pray for Writ of Mandamus declaring the action of the respondents in obstructing the petitioners from watering the palm oil trees, cutting and transporting the palm oil fruit from their land admeasuring Ac.19.75 cents situated in R.S.Nos.346 and 347 of Madicharla village, Bapulapadu Mandal in Krishna District, and in threatening to dig trench in the land of the petitioners as illegal and consequently direct the respondents not to obstruct petitioners from watering their palm oil trees and cutting and transporting the palm oil fruits. Learned Government Pleader takes notice for respondent Nos.1 to 4.

On instructions, it is submitted that several notices were issued to the petitioners to attend for the joint survey with the Forest, Revenue and Survey Officials, but the petitioners did not attend and submit the documentary evidence in respect of the disputed land.

Officials, and basing on the Survey Report, pass necessary orders, by following due process of law. The entire exercise shall be completed within one month from the date of receipt of a copy of this Order by the respondents. The petitioners shall cooperate with the respondent-authorities for smooth completion of survey operations.

Till the above exercise is completed, the respondents shall not obstruct the petitioners from attending watering of the palm oil trees standing on the disputed land. The writ petition is disposed of accordingly. No order as to costs.

As a sequel, miscellaneous applications pending, if any, shall stand closed.
