Heard the counsel for petitioners, and the learned Government Pleader for Revenue, for respondents.

The petitioners' grievance in this Writ Petition is that petitioners had applied for regularization of certain land to 3rd respondent which was excess land under the Urban Land Ceiling and Regulation Act, 1976; that his application for regularization pursuant to G.O.Ms.No.747 Revenue (UC.I) Department dt.18.06.2008 was rejected vide proceedings No.F1/747/5967/08, CC.No.F1/69/83, dt.27.09.2013 by 3rd respondent; in the very same order, the petitioner was permitted refund the amount of Rs.8,12,700/- paid by him; and that till date the money has not been refunded by respondent nos.1 and 2, and therefore, a direction be given to respondent nos.1 and 2 to make the said refund forthwith.

The learned Government Pleader for Revenue, appearing for respondents, states that the application of petitioner for regularization of the excess land was rejected on 27.09.2013, but the amount of Rs.8,12,700/- has not been refunded to petitioner till date. 4.

In this view of the matter, the Writ Petition is allowed. The respondent nos.1 and 2 shall refund the said amount of Rs.8,12,700/- to petitioner with interest at the rate of 7 % per annum from the date

of its payment by petitioner till the date of refund within four (04) weeks from the date of receipt of copy of this order. 5.

The 1st respondent shall also pay costs of Rs.1,000/- to petitioners.

Accordingly, the Writ Petition is allowed as above. 7.

As a sequel, miscellaneous petitions pending if any in this Writ Petition, shall stand closed.
