Heard learned counsel for the petitioner, the learned Assistant Public Prosecutor representing the respondent-State and perused the record.

This petition is filed under Section 438 Cr.P.C. to grant anticipatory bail to the petitioner/accused in crime No.23 of 2018 of Siddapur police station, Nagarkurnool district registered for the offences punishable under Sections 306 and 323 IPC. 3.

The learned counsel for the petitioner would submit that there are no specific and grave allegations against the petitioner/accused. The petitioner and the deceased belong to same village. A false report was lodged by the father of the deceased. The petitioner is a Police Constable and ultimately prayed to allow the petition. 4.

The learned Assistant Public Prosecutor opposed the relief sought by the petitioner/accused.

As per the report lodged by the father of the deceased, dated 14.04.2018, there is a specific mention that the deceased was scolded and abused to commit suicide by the petitioner/accused herein. There is a mention that in an on going marriage, the said abuses and beatings were made. The deceased is the brother-in-law of the petitioner/accused. There is a specific mention of the overt acts

against the petitioner/accused. Therefore, it is not a fit case to allow the petition under Section 438 Cr.P.C.
