Gosu Ramachandra Reddy And 2 Others v. The State Of A.P. And Another
SMT. JUSTICE T.RAJANI CRIMINAL PETITION No.9474 of 2011 ORDER:
This criminal petition is filed under Section 482 Cr.P.C., seeking to quash the proceedings in P.R.C.No.26 of 2007 on the file of the Judicial First Class Magistrate, Tadipatri, Anantapur District, registered for the offences under Sections 147, 148, 324, 307, 332, 435 read with Section 149 IPC, against the petitioners/A6, A37 and A38.
2.
Heard learned counsel for the petitioners and learned Public Prosecutor for the first respondent-State. None appears for the second respondent in spite of service of notice. 3.
Learned counsel for the petitioners submits that a false case is filed against the petitioners in view of political rivalry. 4.
Except the ground of political rivalry, the petitioners are not able to submit any other reason for quashment of the proceedings. Hence, this Court finds that unless the matter is subjected to trial, the truth cannot be brought on record.
5.
Hence, in view of the above, the Criminal Petition is dismissed. However, in view of the request made by the learned counsel for the petitioners, the trial Court is directed not to insist the appearance of the petitioners/A6, A37 and A38, except on the dates whenever their presence is necessary. Miscellaneous applications, if any, pending in this criminal petition shall stand dismissed. ___________ T. RAJANI, J 15th November, 2018.
