Heard learned counsel for the petitioner, the learned Additional Public Prosecutor and perused the record.

This petition is filed under Section 438 Cr.P.C. to grant anticipatory bail to the petitioner/accused No.1 in crime No.88 of 2018 of Proddatur III Town police station, Kadapa district registered for the offences punishable under Sections 498-A and 420 IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961. 3.

The learned counsel for the petitioner/accused No.1 would submit that the allegations made in the report lodged against him are false. The petitioner did not make any dowry demand and did not harass the de facto complainant. This is the second complaint lodged by the de facto complainant. The petitioner has also filed D.O.P.No.94 of 2014 on the file of the Senior Civil Judge, Proddutur, for divorce and the said petition ended in compromise before the Lok Adalat. Thereafter, both parties started living together. As the petitioner did not agree to put up a separate family, a false complaint is lodged against him.

As per the First Information Report lodged before Proddatur III Town Police Station, there are number of allegations against the petitioner/accused No.1 and other accused persons including demand

of Rs.10.00 lakhs as additional dowry. There is specific allegation that the other accused persons also caused mental and physical agony against the de facto complainant, who is the wife of the petitioner/accused No.1. It is also mentioned that the petitioner compromised the D.O.P. stating that he would look after the de facto complainant very well, but he did not do so. There are also allegations against the other relatives of the petitioner. In these circumstances and in view of the gravity and nature of the allegations against the petitioner, he is not entitled for bail under Section 438 Cr.P.C.
