THE HON'BLE SRI JUSTICE K. SURENDER CRIMINAL PETITION NO. 7449 OF 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioners/A1, A2, A4 to A14 seeking bail in the event of their arrest in connection with Crime No.95/2023 on the file of Garla Bayyaram Police Station, Mahabubabad, registered for the offences punishable under Sections 143, 290, 506, 447, 436 r/w.149 of Indian Penal Code and Section 3(1)(r)(s), 3(2)(va) of SC/ST POA Act.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent - State and perused the record.

Since it is stated by learned Counsel appearing for the petitioners that A6, A11 and A14 were arrested, Criminal Petition in respect of A6, A11 and A14 is dismissed.

Briefly, the case of the prosecution is that the defacto complainant filed a complaint stating that Accused No.1 who is MPP of Bayyaram, along with other accused, criminally trespassed into his premises. Cattle was sent out and roof of the cattle shed was set on fire by pouring petrol. When the wife of the defacto

complainant intervened, the accused abused her in language attracting penal consequences under SC/ST (POA) Act. Accused No.1 and others threatened with dire consequences and left. 5.

As seen from the complaint, the 1st petitioner/A1 had taken other members and was responsible for burning the cattle shed. As far as the other petitioners are concerned who are A2, A4, A5, A7 to A10, A12 and A13, it is stated that they were part of the group who came along with 1st petitioner/A1.

Keeping in view the allegations, this Court is not inclined to grant the relief of Anticipatory Bail to the 1st petitioner/A1. However the other accused i.e. A2, A4, A5, A7 to A10, A12 and A13, are concerned, the relief of Anticipatory Bail can be granted on the following conditions.

1) The petitioners 2,3,4,6,7,8,9,11 & 12 /A2, A4, A5, A7 to A10, A12 and A13 are directed to surrender before the Station House Officer, Garla Bayyaram Police Station, Mahabubabad, on 21.08.2023. On such surrender, the said Station House Officer shall release them on bail, on their executing personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only)each with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioners 2,3,4,6,7,8,9,11 & 12 /A2, A4, A5, A7 to A10, A12 and A13 shall appear as

and when directed before the said Station House Officer, for the purpose of investigation.

3) The petitioners 2,3,4,6,7,8,9,11 & 12 /A2, A4, A5, A7 to A10, A12 and A13 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall cooperate with the Investigating Officer in investigating the case.

Accordingly, the criminal petition is partly allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
