THE HON'BLE SMT JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.2404 OF 2007 ORDER:

This writ petition is filed questioning the notification dated 3.7.2006, issued under Section 4(1) of the Land Acquisition Act, 1894 (for short, "the Act"), proposing to acquire the land for an extent of Acs.2.93 cents of the petitioners situated at Sy.No.94, Donthavaram Village, Ungutur Mandal, West Godavari District. On 12.2.2007, this Court while admitting the writ petition granted interim stay of all further proceedings including the dispossession of the petitioners.

Today, when the matter is taken up for hearing, learned Government Pleader for Land Acquisition submitted the written instructions of the Tahsildar, Unguturu, wherein it is stated that the land owners have given their consent for an extent of Ac.2.93 cents in R.S.No.94/1A, 1B,1C,94/2 and 94/5 of Donthavaram Village, Unguturu Mandal. It is further stated that the respondents have paid an amount of Rs.4,41,750/- to the 2nd petitioner for an extent of Ac.0.93 cents and an amount of Rs.9,50,000/- was paid to the 1st petitioner under proper acknowledgment by the Land Acquisition Officer-cum-Revenue Divisional Officer, Eluru and the acquired land was distributed to the houseless poor people in Donthavaram Village of Unguturu Mandal in the year 2008. Learned counsel for the petitioners did not dispute the contents of the written instructions dated 28.11.2017 of the Tahsildar, Ungutur.

In view of the facts and circumstances stated above and as the award has been passed and compensation amounts have been

paid to the petitioners, no further orders are required to be passed in this matter and the writ petition is liable to be closed. Accordingly, the writ petition is closed. No order as to costs. Consequently, the Miscellaneous Petitions pending, if any, shall also stand closed.
