THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.39046 of 2016 ORDER:

Heard Ms.Pulipati Radhika for petitioner and Ms.J.Koteswari Devi for respondents 1 to 5.

The petitioner challenges Letter dated 28-05-2016, whereunder the petitioner is called upon to pay a sum of Rs.1,43,507.97 Ps. The counsel for petitioner made a few strong submissions on the very factual basis in issuing impugned notice as illegal and untenable.

This court is of the view that these circumstances are available to petitioner to represent and convince the authority about the illegality of impugned demand. As on date, it is stated that the respondents have disconnected the power supply to petitioner's rice mill and is suffering. Prays for restoration of power supply. The Standing Counsel prays for imposing condition of deposit of demanded amount.

I am satisfied, for the present, particularly without going into the merits of the issues, the writ petition can be disposed of by this order.

(a) The petitioner shall deposit a sum of Rs.71,500/ - (Rupees seventy one thousand five hundred only) and on such deposit, respondents 4 and 5 are directed to restore power supply to petitioner.

(b) The petitioner is given two weeks time from today to submit explanation together with proof of non-utilization of power against the subject demand.

(c) Respondents 4 and 5 are directed to dispose of the explanation within eight weeks from today.

(d) It is made clear that after restoration of power supply, the petitioner continues to pay current consumption charges without fail.

The writ petition is disposed of accordingly. No order as to costs.
