HON'BLE SRI JUSTICE U.DURGA PRASAD RAO WRIT PETITION No. 17682 of 2018 ORDER:

The petitioner seeks a Writ of Mandamus, declaring the action of the respondents, mainly respondent no.2, in taking coercive steps for dispossessing the petitioner from his patta land situated in Sy.No.210/ 3 to an extent of Ac.4.59 cents and in Sy.No.201/ 4 to an extent of Ac.0.63 cents, total extent of Ac.5.22 situated in Veera Kaveri Raju Puram, Nagari Mandal, Chittoor District without following the due process of law, as arbitrary.

Learned Government Pleader for Revenue, taking notice for the respondents, would submit that originally, the lands were assigned n favour of one K.Bhagyamma, W/ o. Ramachandran vide D.K.T.No. 814/ 4/ 79, and the writ petitioner, in contravention of the provisions of the Andhra Pradesh Assigned Lands (Prohibition and Transfer) Act, 2007, purchased the said land from the original assignee and the revenue authorities have initiated proceedings under the said Act, and it is false that the respondents are trying to dispossess him without following the due process of law.

In the light of the above submission, this Writ Petition is disposed of with a direction to the respondents to strictly follow the due process of law for initiating the proceedings against the petitioner under Andhra
